Terms of Service for MeHungry

1. Agreement to Terms

By downloading, installing, or using the MeHungry mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use our App.

MeHungry LLC ("MeHungry," "we," "us," or "our") operates the App, which provides a platform to discover restaurants, food carts, food trucks, and other food vendors ("Vendors") in your area.

2. Description of Service

MeHungry provides:

  • A platform to discover food vendors near you
  • Search and filter capabilities for finding food options
  • Information about vendor locations, hours, and offerings
  • Sponsored placement opportunities for vendors (clearly marked)

MeHungry is NOT responsible for:

  • The quality, safety, or legality of food from vendors
  • The accuracy of vendor-provided information
  • Transactions between you and vendors
  • Any harm resulting from your interaction with vendors
  • Campaign performance or return on investment
  • Changes in sponsored placement due to algorithm updates or competitor actions

3. User Accounts

Account Creation

  • You must provide accurate, current, and complete information
  • You may register using either an email address or phone number
  • You are responsible for maintaining the confidentiality of your login credentials
  • You must notify us immediately of any unauthorized account use

Account Restrictions

  • You must be at least 13 years old to use MeHungry
  • One account per person
  • You may not use another person's account

4. Sponsored Vendors and Advertising

Some vendors pay for enhanced visibility in our App through our sponsored placement advertising services. These paid placements are clearly marked with "Sponsored" labels. The presence of sponsored content does not constitute an endorsement by MeHungry of any vendor, product, or service.

For Vendors - MeHungry Edge (Sponsored Placement)

Service Description: MeHungry Edge provides pay-per-display advertising services to restaurant owners and food vendors. By creating an Edge campaign, your business can gain sponsored placement in customer search results.

How It Works

  • Pay-per-display model - you only pay when your business is shown to users
  • Set your bid amount (how much you're willing to pay per display)
  • Set a monthly budget cap to control spending
  • Higher bid amounts may result in better placement among sponsored results
  • Your listing displays a "Sponsored" label to customers
  • Campaigns are billed daily for the previous day's displays
  • Payment processing handled securely by Stripe (our third-party payment processor)

Sponsored Placement Disclaimer

  • Actual placement depends on competing vendor bids, user location, search parameters, and our proprietary algorithm
  • Sponsored placement may change at any time without notice
  • Payment guarantees inclusion in sponsored results with "Sponsored" label, but does not guarantee specific position
  • We do not guarantee specific results, customer views, or business outcomes from sponsored placement

Billing and Cancellation

  • Campaign Pause/Cancellation: Pause or end your campaign anytime from your vendor dashboard
  • Billing: You are charged daily for displays delivered the previous day
  • Budget Cap: Once your monthly budget is reached, your campaign pauses until the next month
  • No Refunds: Charges for displays already delivered are non-refundable
  • MeHungry-Initiated Termination:
    • For cause (Terms violation, fraud): No refund, immediate termination
    • Without cause: No charges for undelivered displays

Anti-Fraud Provision

  • Attempting to convert promotional credits to cash may result in account termination
  • We track all credit applications and transactions

Payment Processing

  • All payments are processed by Stripe, our secure third-party payment processor
  • Payment setup and management occurs via web interface (not in-app purchase)
  • Stripe handles all billing, invoices, and payment methods
  • We receive confirmation of payment status but do not store full credit card details

Our Rights

  • We reserve the absolute right to refuse or remove any sponsored placement
  • We may reject any vendor for any reason
  • We may modify plan terms with 30 days notice

5. Acceptable Use Policy

You agree NOT to:

  • Use the App for any illegal purpose
  • Harass, abuse, or harm other users or vendors
  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the App
  • Scrape, harvest, or collect data from the App without permission
  • Use the App to transmit spam or unsolicited communications
  • Impersonate any person or entity
  • Violate any applicable laws or regulations

6. Intellectual Property Rights

Our Content

All content in the App, including text, graphics, logos, and software, is owned by MeHungry or our licensors and is protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

User Content

By submitting any content to MeHungry (such as reviews or feedback), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with operating the App.

Vendor Content

Vendors retain ownership of their content (menus, descriptions, images). By listing on MeHungry, vendors grant us a license to display their content in the App.

Trademarks

MeHungry™ is a trademark of MeHungry LLC. All other trademarks, service marks, and logos used on this site are the property of their respective owners.

7. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

Data Retention

Even after account deletion, we retain certain records as required by law including:

  • Financial and tax records (retained for 7 years)
  • Records necessary for legal claims or disputes
  • Anonymized analytics data
  • Documentation of deletion requests

8. Third-Party Services and Links

The App may contain links to third-party websites or services (including vendor websites). We are not responsible for the content, privacy policies, or practices of third-party sites or services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF INFORMATION

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • The results from using the App will meet your requirements

FOOD SAFETY DISCLAIMER: MeHungry does not inspect, verify, or guarantee the safety, quality, or legality of any food vendor or their products. Users assume all risks associated with purchasing and consuming food from vendors listed in our App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEHUNGRY SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the App
  • Any conduct or content of any third party, including vendors
  • Unauthorized access or alteration of your data

IN NO EVENT SHALL MEHUNGRY'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO MEHUNGRY (IF ANY) IN THE PAST TWELVE MONTHS.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless MeHungry, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the App
  • Any chargebacks, disputes, or claims related to your subscription payments
  • Any attempts to circumvent our payment or credit systems

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of California, without regard to conflict of law provisions.

Arbitration

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Sacramento, California.

Class Action Waiver

You agree to bring claims against MeHungry only in your individual capacity and not as part of any class action or representative proceeding.

13. Termination and Right to Refuse Service

Our Rights

  • We reserve the absolute right to refuse service to anyone for any reason at any time
  • We may terminate or suspend any account immediately, with or without cause or notice
  • We may refuse, cancel, or terminate any vendor's sponsored placement at our sole discretion
  • We may modify, suspend, or discontinue the App (or any part thereof) at any time
  • We are not liable to you or any third party for any modification, suspension, or discontinuation of service

Reasons for Termination (Including but Not Limited to)

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Behavior that is harmful to other users, vendors, or MeHungry
  • At our sole discretion for any reason or no reason

Your Rights

  • You may terminate your account at any time by contacting us
  • Upon termination, your right to use the App ceases immediately

Effect of Termination

  • All licenses and rights granted to you immediately terminate
  • You must cease all use of the App
  • Any fees paid are non-refundable unless otherwise required by law
  • Sections that by their nature should survive termination will survive

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Sending a notification (for material changes)

Your continued use of the App after changes constitutes acceptance of the modified Terms.

15. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and MeHungry regarding the App.

Severability

If any provision of these Terms is found invalid, the remaining provisions will continue in full force.

Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

Assignment

You may not assign these Terms without our consent. We may assign our rights to any successor or acquirer.

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

17. Special Terms for Vendors

If you are a vendor using MeHungry's sponsored placement advertising services, additional terms apply:

  • You must provide accurate business information
  • You are responsible for complying with all applicable food safety and business regulations
  • You may not make false or misleading claims about your products or services
  • Payment obligations continue regardless of App performance or results
  • We reserve the right to remove or refuse any vendor listing
  • All sponsored content must comply with Federal Trade Commission guidelines and display required disclosures
  • You are responsible for all applicable taxes related to your plan payments

18. Plan Billing and Auto-Renewal

Auto-Renewal: Monthly plans automatically renew on the same day each month unless canceled. You authorize us to charge your payment method automatically for each renewal period.

Price Changes: We may change plan pricing with 30 days advance notice. Your continued use after the notice period constitutes acceptance of the new pricing.

Failed Payments: If payment fails, we may retry charging your payment method. Continued failure may result in suspension or termination of sponsored placement.

Cancellation: You may cancel your plan at any time through the App. Cancellation stops future charges but does not refund the current billing period unless you delete your location entirely.

Credits and Promotions: We may offer promotional credits. These have no cash value and cannot be refunded, transferred, or exchanged for cash.

19. California-Specific Provisions

As a California-based company, we comply with the California Consumer Privacy Act (CCPA) and other applicable California laws. California residents have specific rights outlined in our Privacy Policy.

By using the MeHungry App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
